Albany Law School Journal of Science & Technology Publishes Eric Chaffin’s Presentation on Off-Label Marketing of Drugs and Devices

Chaffin Luhana LLP announces the publication of partner Eric Chaffin’s presentation “Off-Label Use from an Injured Consumers’ Perspective” in the Albany Law Journal of Science & Technology.

This volume of the nationally ranked legal journal is a transcript of the presentations made on March 27, 2009 at Albany Law School’s  symposium on the issue of off-label drug use entitled “Regulating the Cure: Topics Arising out of the Prescription of Drugs Off-Label.”  The symposium consisted of three panels on the following topics: off-label drug use and bio-ethics, current topics in off-label drug use litigation, and a panel on marketing and speech limitations for off-label drugs.  Partner Eric Chaffin was a featured speaker and discussed how off-label use of drugs or medical devices changes a typical consumer mass tort. Other speakers included  Sarah L. Scarpace (Albany College of Pharmacy & Health Sciences),  Dan R. Thompson  (Albany Medical College), Michael Kane (Albany College of Pharmacy & Health Sciences), Patrick J. Igoe (Registered Patent Attorney), Byron Stier (Southwestern Law School) , Mollie Hertel (U.S. Government Accountability Office) and  Raul A. Tabora Jr. (Ruffo, Tabora). The discussion covered issues including what is actionable by a consumer, theories of liability, potential defendants and likelihood of recovery.

The Albany Law Journal of Science & Technology is a student-run scholarly law publication, and is ranked fifth among all technology journals in the nation according to the Washington & Lee Law School ranking system.  The Journal publishes scholarly work relating to technological, scientific, medical, intellectual property, and social science issues.  The symposia from previous years have included topics such as nanotechnology and voting technology.
 
About the Author: Eric Chaffin

Mr. Chaffin is a trial lawyer and a founding  partner of Chaffin Luhana LLP.  He is a former Assistant U.S. Attorney in New York and a former Adjunct Clinical Professor of Law at Brooklyn Law School, where he taught in the areas of federal prosecutions and trial advocacy.  Mr. Chaffin has also authored various articles, including: “De-Escalate the Expert Discovery Wars,” AAJ Trial Magazine (June 2008).

Chaffin Luhana Continues Yaz, Yasmin and Ocella Lawsuit Investigations
