Roopal Luhana Appointed to the Plaintiffs’ Steering Committee in the National Yaz & Yasmin MDL Litigation

On November 23, 2009, Roopal Luhana was appointed by Judge Herndon of the United States District Court for the Southern District of Illinois to the Plaintiffs’ Steering Committee (PSC) in the In re Yasmin and Yaz (Drospirednone) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2100.  Ms. Luhana is one of two women who Judge Herndon appointed to the PSC, which is responsible for overseeing this important national litigation on behalf of the injured women who have filed and will file cases in federal court. 

Along with other members of the PSC, Ms. Luhana will be responsible for, among other things: coordinating and conducting all pretrial discovery; examining witnesses, and introducing evidence on behalf of all plaintiffs at hearings before the court; acting as a spokesperson for all plaintiffs at pretrial proceedings and in response to any requests by the Court; submitting and arguing motions; and exploring, developing and pursuing all settlement options pertaining to any claim or portion thereof in any case filed in the MDL litigation. 

Along with partner Eric Chaffin, Ms. Luhana represents dozens of women in Yaz lawsuits and Yazmin lawsuits who have suffered from heart attacks, strokes, pulmonary embolisms, deep vein thromboses, gallbladder disease, or death from using Yaz, Yasmin and/or the generic version, Ocella.  To date, they have filed five cases for women who have suffered injuries from Yaz and/or Yasmin in against Bayer and related entities. 

The organization of the MDL before Judge Herndon follows an August 14, 2009, study published in the British Medical Journal Online about Yasmin & Yaz birth control that found that the risk of blood clots in women who use Yaz and Yasmin is significantly higher compared to that of other oral contraceptives.  Ms. Luhana and Mr. Chaffin advocate that Bayer needs to revise its warning labels for Yaz and Yasmin, especially in light of the findings of the new studies.
