Today Show Segment on Health Risks for Ortho Evra Patch Features Chaffin Luhana LLP’s Case for Grieving Mother

New York, New York, September 22, 2010, Chaffin Luhana LLP announces that NBC’s Today Show aired a segment about a wrongful death case involving the Ortho Evra Birth Control Patch.  The segment featured an interview with firm client Leslie Niedner and statements from Partner Roopal Luhana.  Ms. Niedner’s daughter, Adrianna Duffy, died on September 28, 2009 at the age of 17 from a bilateral pulmonary embolus allegedly caused from her use of the Ortho Evra Birth Control Patch.  Ms. Duffy was a 2009 graduate of Concord Academy in Massachusetts and at the time of her death, she was a freshman at Trinity College in Connecticut. 

The Today Show segment follows the firm’s filing of a wrongful death action in Massachusetts State Court by Ms. Niedner on behalf of Adrianna’s Estate.  The Complaint alleges that Defendants Ortho-McNeil Pharmaceutical, Inc., Johnson and Johnson, and Johnson and Johnson Pharmaceutical Research and Development, LLC f/k/a R.W. Johnson Pharmaceutical Research Institute defectively designed, manufactured and inadequately labeled the Ortho Evra Patch, which delivered inconsistent and sometimes lethal doses of estrogen that resulted in Adrianna’s death. 

The Duffy case follows years of litigation surrounding the Ortho Evra Birth Control Patch and highlights that despite the warning label changes to the product, it is not safe. “We hope the airing of this segment on the Today Show will inform consumers of the serious health risks posed by the Ortho Evra Birth Control Patch, and sincerely hope that Johnson & Johnson will withdraw the Patch from the market,” said Partner Roopal Luhana.
