According to the United States Department of Justice (DOJ), sexual assault is any nonconsensual sexual act, including when the victim doesn’t have the capacity to consent (e.g. when they are intoxicated or asleep).
According to the Rape, Abuse & Incest National Network (RAINN) sexual assault is any sexual behavior that happens without “explicit consent” of the victim.

2. What Is Consent?
